Use of Craft: The hirer shall receive the craft described on the contract in good condition, with all its accessories and undertakes to preserve them and use the craft in compliance with maritime norms, regulations and laws. The following is expressly prohibited:

• a) For persons not authorized on the contract to use the craft.
• b) To carry persons in excess of that specified.
• c) Explicitly or implicitly re-renting the craft.
• d) To participate with the craft in races, competitions (other than those organized by The Grand Selection S.L.L. and/or its agents) or bets of any nature.
• e) To participate in any illegal acts or to carry any form of illegal goods or substances.

The liability of the Renter: The renter declares that it has taken all due precautions to avoid failures of the rented craft, but if such failures should occur, it may not be held responsible for any damages directly or indirectly caused to the hirer as a result of such failures or breakdowns.

Qualifications: The hirer and/or the responsible person authorized by The Grand Selection S.L.L. shall be in possession of the relevant qualification and adequate experience to handle the craft. The hirer will be asked for proof of identity, address of permanent residence and relevant qualifications. The minimum age of the hirer shall be eighteen years.

Operating hours: One-day rental (eight hours) will commence at 10:00 and finish at 18:00. Four hours Morning rental will commence 10:00 and finish at 14:00. Four hours Afternoon rental (high season only) will commence at 15:00 and finish at 19:00.

Return of the Craft: The hirer shall return the rented craft along with all its accessories, in the place and at the time stipulated on the contract. Any change there to shall have to be previously authorized by the renter. Non-compliance with this condition empowers the renter to make additional charges as deemed appropriate.

Prices: All prices are quoted in Euros (unless otherwise stated). Prices apply at the time of printing and may alter before the booking is made. If any alteration in costs is unavoidable this will be advised in the final balance sent to the hirer 15 days before commencement. On confirmation of the arrangements a contract exists between the renter and the hirer. Spanish law governs this contract.

Rental Charges: The hirer undertakes to pay the renter:

• a) The charges for rental referred to in the schedule of charges of the renter. Applying the charges initially agreed upon shall require the return of the craft in the place and at the time agreed.
• b) Charges for additional requests and/or items such as catering, alcoholic beverages, fuel and port fees.
• c) Charges incurred due to loss of accessories.
• d) Fines and legal expenses incurred due to infringement of maritime norms, or breach of law, regulations or orders on behalf of the hirer.
• e) Charges incurred for breakage or damage due to improper use. The hirer shall always be obliged to pay the renter the amount due for paralysing the craft during the duration of its repair at the price stipulated in the schedule of fees.

Terms of payment: Reservation – 50% of the estimated hire charge. The balance to be paid 10 days before charter.

Payment: Upon signature of the contract, the hirer shall pay the renter the estimated sum of the hire and may be asked to pay an additional sum as a bond, which shall be established in accordance with the renter’s criterion, which amount shall be returned at the end of the contract, provided it does not have to be made use of to pay for any type of expenses which might have been incurred by the hirer. The amount for the service may be charged to the main credit card entities (Visa, MasterCard etc. except American Express).

Alteration of Booking: If the hirer needs to alter the arrangements after we have sent the confirmation of the booking, there will be administration and/or other charges as deemed appropriate by the renter for each alteration. A hirer wishing to add to a party after the initial booking will only be able to do so if sufficient places are available. This should not be automatically assumed to be possible and the hirer should telephone or send an e-mail to check first.

Alteration of Services: The arrangements for hire are made many weeks in advance and it is sometimes inevitable that changes may become necessary. We reserve the right to make such changes should they become necessary. Most of these changes will be minor and we will advise the hirer of them at the earliest possible date. We also reserve the right in any circumstances to cancel the arrangements. For example, if the weather conditions are inappropriate. If we are unable to provide the booked arrangements, the hirer can either have a refund of the charter fee paid (excluding extras requested for the event) or accept an offer of alternative arrangements of comparable standard from us, except for reasons of force majeure or failure by the hirer to pay the final balance. Responsible persons authorized by The Grand Selection S.L.L. and charter staff are responsible for the safe conduct of the activities and may vary the itinerary to that end. They alone shall decide whether or not the activities are available or conditions are safe to use the craft.

Force Majeure: This means that if we have to cancel or change the arrangements in any way because of war, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other unforeseen circumstances that may amount to force majeure.

Cancellation of Booking: All transfers are charged garage to garage - A reservation can be canceled by email or fax with a fixed fee of 20% of the sale. The cancellation must be received no later than 7 days before the transfer date. In case of late cancellation by the customer subsequent to 7 days before the transfer, the grand selection billing as 100% absent at any departure or arrival - If additional stop or waiting time causes the transfers time to exceed the cap time, additional hour(s) will be charged, 4 hours minimum charge for hourly service - Supplement for night service / Sundays / Bank Holidays - Invoices are payable upon receipt. - Any complaint must be made within 8 days of service. The grand selection is not responsible for passenger flights or trains which are missed, cancelled, diverted, delayed or any other incident which results in failure to comply with the Cancellation Policy. We will exact our best effort to fulfill client needs in these instances subject to wait time fees or late cancellations and re-bookings without detriment to other reserved clients. Full trip charge will apply if the passenger fails to contact our office if they unable to locate their chauffeur. DEPOSITS ARE NON-REFUNDABLE.

Weather Conditions: The renter cannot be held responsible for changes in the weather. 24 hours before commencement of hire the hirer will be informed about the general weather forecast and the opinions of our staff. With this information 24 hours before commencement, the hirer can make the decision to continue or not.

Jurisdiction: Any disagreement, which should arise between the renter and the hirer, shall be submitted to the courts of Málaga where rental began, and any other court is expressly waived.

Complaints: If a hirer has a problem during their hire, they should inform a relevant member of staff immediately, who will endeavour to put things right. If the complaint is not resolved to their satisfaction, they should inform the directors or The Grand Selection S.L.L. who will investigate the matter further.
